Terms and conditions

 

The knowledge community is a website that provides free and easy to use tools to help people share, learn and work together. Throughout this document we use the term KC to mean the knowledge community.

The Care Services Improvement Partnership (CSIP) operates the KC.

CSIP is commissioned by the Department of Health to support positive changes in services and in the wellbeing of people with health and social care needs. CSIP works through eight regions while its central team is based at Room 8E 44, Quarry House, Quarry Hill, Leeds, LS2 7UE England. Knowledge community terms and licence

Please read the following terms and conditions and privacy policy (together ‘the terms’) carefully before you use the KC. If you do not accept these terms you cannot use the KC. Our privacy policy can be read at http://kc.csip.org.uk/privacy-policy.php

By using the KC you agree to be legally bound by these terms, which shall take effect immediately on your first use of the KC. If you do not agree to be legally bound by all the following terms please do not access and/or use the KC.

To use certain areas of the KC, you must register following our stated procedures. Please read the section titled registration below.

We may restrict your access to the whole or any part of the KC and change the levels of access that you have to materials on or parts of the KC at any time at our discretion.

We may amend the terms at any time by posting such amendment on the KC at http://kc.csip.org.uk/terms-and-conditions.php. We recommend that you monitor the terms from time to time to ensure you are aware of any changes made by us. Your continued use of the KC after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

We may add to or delete any part or the entire KC at our discretion at any time. Unauthorised use of the KC may give rise to a claim for damages and/or be a criminal offence. We shall be permitted to restrict, suspend or terminate your licence and/or use of the KC at any time without notice. We will do this if we have reasonable grounds to believe that you are in breach of any of the terms or your use of the KC is inappropriate or otherwise unacceptable.

Nothing on this KC is intended to or should be interpreted to be an offer to enter into a contractual relationship.

You agree to comply with any security policy or guideline relating to the access or use of the KC that we may notify you of from time to time in writing.


Use of the knowledge community

You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use KC content for commercial use.

You may not to adapt, alter or create a derivative work from any KC content for commercial use.

You are only permitted to share content on the KC provided you do so in a responsible manner, using common sense and caution and exercising proper judgment.

We are under no obligation to post any content that you have submitted to the KC.


Liability and indemnity

Under no circumstances will CSIP be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the KC regardless of the form of action.

You hereby agree to indemnify CSIP from and against any loss, damage, costs, proceedings claims and liability ‘claims’ suffered or incurred by us arising out of or in connection with your use of the KC.


Intellectual Property

The names, images and logos identifying CSIP or third parties and their products and services are subject to copyright, design rights and trade marks of CSIP and/or third parties. Nothing contained in these terms shall be construed as conferring by implication or otherwise any licence or right to use any trademark, patent, design right or copyright of the CSIP or any other third party.


Contributions

You are only permitted to share content on the KC provided you do so in a responsible manner, using common sense and caution and exercising proper judgment. The content shall not be defamatory, obscene, pornographic, abusive, racist or threatening in any way and its use and holding shall not otherwise be contrary to law.

Any ideas, suggestions, thoughts, recommendations, opinions, comments, advice or observations set out in the content are those of the person submitting the content and do not represent those of CSIP.

By submitting content you hereby grant CSIP an irrevocable, perpetual, royalty free, non-exclusive and worldwide licence to edit, amend, modify, reproduce, publish, translate, distribute the content, in whole or in part, in any form or media.

You also permit any other user of the KC to access, display, view, store and reproduce such content, providing that it is not for commercial use.

CSIP makes no guarantee regarding the reliability, accuracy, or quality of the content.

CSIP is under no obligation to post any content that you have submitted to the KC.

You shall not, in submitting content, impersonate any other person (whether actual or fictitious) or otherwise falsify the origin of the content.

We also confirm that we will use all reasonable endeavours to remove content that users may find offensive as soon as it is brought to our attention. Please notify us at feedback@kc.csip.org.uk.


Accuracy of information

The information contained in or accessible through our external links from the KC is made available in good faith and for general information and interest only. It is subject to change without notice. We are not responsible for any inaccuracies.

The information on the KC is general in nature and should not be relied upon. It does not constitute any form of advice or recommendation for your particular needs. You must decide for yourself if any information is suitable for your needs. Any arrangements made between you and any third party named or referred to on the KC are entirely at your sole risk and responsibility.

In using the KC, you agree that any information you provide about yourself when you register or at any other time will be true, accurate and complete and you will ensure that this information is kept accurate and up to date at all times by notifying us immediately if the details you have provided to us change.


Linking

The KC contains links to other websites. We do not accept nor do we assume any responsibility or liability for the content of other websites. Any link is not intended to be, nor should be construed as, an endorsement of any kind by us of that other website

You must notify us if you wish to link to the KC from another website or document and obtain our approval in writing before any link is made. We have the right to refuse the use of this link and to require the same to be disconnected at any time.

You must remove any links to the KC, to another website linked to the KC or document, on our request.


Registration

You will choose a password when you register, to enable you to use certain areas of the KC. You will receive confirmation of this password in an email sent by us. You must keep the password secure and confidential at all times. You must provide your email address and password (“log in”), to enable you to use certain areas of the KC. You can change your password at any time by visiting http://kc.csip.org.uk/profile.php

You will be liable for all use of your password including access of material made through use of the password, whether authorised or unauthorised. If you become aware of any unauthorised use of your password please notify us immediately at feedback@kc.csip.org.uk.

In the event that you forget your password, please use the ‘forgotten password’ form on the log in page http://kc.csip.org.uk/login.php. This will send a reminder of your current password to your email address

Misuse of the KC will lead to the removal of your access to privileged areas of the KC.

Jurisdiction and acceptance of these terms and conditions

The KC is controlled and operated by CSIP from its offices in England.

These terms shall be governed by and interpreted in accordance with the laws of England and Wales.
